This policy outlines MDARD’s current position of online food delivery service businesses. While this concept is a growing trend updates to this policy may occur in the future to address any emerging issues.
Defined by policy food delivery service means shippers and carriers in operations in which food is transported directly to the consumer from an FE as part of normal retail operation.
Online food delivery services transporting food directly to the consumer may be from the licensed FE or a third-party delivery service.
A mobile FE means an FE operating from a vehicle that returns to a mobile FE commissary for servicing and maintenance at least every 24 hours.
While a mobile FE may also have online food delivery service capability these operations can also conduct mobile, door to door or point of sale transactions of food.
Online food delivery services cannot conduct mobile, door to door or point of sale transactions of food.
Storage is not allowed for food delivery services and food must be delivered immediately after obtaining.
Food delivery services are not required to be licensed by MDARD if the operation is only involved in transport of food directly to the consumer as part of normal retail operation.
Food intended for transport by food delivery services shall be acquired as an approved source from a food establishment.
Complaints against online food delivery services will be followed up at the licensed MDARD FE or forwarded to the regulatory agency in charge of where the food was obtained.
